These Terms of Service govern your access to the Elevate Agents website and any services provided under them. By using the website, you agree to these terms. Specific client engagements may also be governed by a separate written agreement; if there is a conflict, that agreement controls for the applicable services.
1. Our services
Elevate Agents provides AI strategy, automation, agent deployment, implementation, advisory, and related business services. Information on this website is general and may change. The scope, timing, fees, responsibilities, and deliverables for paid services will be described in a proposal, statement of work, order form, or other written agreement.
2. Eligibility and acceptable use
You must be legally able to enter into a binding agreement to use our services. You agree not to misuse the website or services, interfere with their operation or security, attempt unauthorized access, introduce malicious code, violate another person's rights, or use the services for unlawful, deceptive, or harmful purposes.
3. Client responsibilities
You are responsible for providing accurate information, timely access, appropriate permissions, and lawful instructions needed to perform the services. You are also responsible for reviewing outputs and making final business, legal, financial, employment, and operational decisions. You must not provide data or materials you do not have the right to use.
4. AI systems and outputs
AI-generated results may be incomplete, inaccurate, or unsuitable for a particular purpose. Outputs should be reviewed by qualified people before use, especially for consequential decisions. Unless expressly agreed in writing, we do not guarantee that any AI system or output will be error-free, uninterrupted, unique, or achieve a specific result.
5. Fees and payment
Fees, invoicing, taxes, expenses, payment timing, and cancellation terms for paid services are established in the applicable written agreement. Unless that agreement says otherwise, amounts paid are non-refundable to the extent permitted by law.
6. Intellectual property
Elevate Agents and its licensors retain all rights in the website, brand, methodologies, software, templates, know-how, and pre-existing materials. You retain ownership of materials you provide. Ownership and licensing of custom deliverables will be defined in the applicable written agreement. You grant us the limited rights needed to use your materials to provide the services.
7. Confidentiality and data
Confidential information exchanged during a client engagement will be handled under the applicable written agreement. Our collection and use of personal information through the website is described in our Privacy Policy.
8. Third-party services
Our website and services may depend on third-party platforms, models, software, or integrations. Their availability, performance, terms, and data practices are outside our control. You may need to accept separate third-party terms to use certain functionality.
9. Disclaimers
To the fullest extent permitted by law, the website and any services provided without a separate written warranty are offered “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing.
10. Limitation of liability

Any liability related to paid services will be subject to the limits in the applicable written agreement.
11. Indemnification
You agree to defend, indemnify, and hold Elevate Agents harmless from claims, losses, and expenses arising from your unlawful misuse of the website or services, your violation of these terms, or materials and instructions you provide that infringe another person's rights.
12. Suspension and termination
We may suspend or terminate access to the website or services if you violate these terms, create security or legal risk, or fail to pay applicable fees. Provisions that by their nature should survive termination will remain in effect.
13. Changes to these terms
We may update these terms from time to time. The revised terms will be posted here with a new effective date. Continued use after changes take effect means you accept the updated terms.
14. General terms
If any provision is unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these terms without our consent; we may assign them in connection with a reorganization, merger, acquisition, or sale of assets. These terms, together with applicable written agreements and the Privacy Policy, constitute the agreement governing your use of the website and services.
